Melting and Refreezing of Ice Can Be Dangerous

As drivers, we have all experienced what happens to our vehicles when we ride over patches of ice.  It is a frightening feeling to be unable to control the steering.  In one case handled by Worby Groner Edelman, our client rode over an area of ice, lost control of the vehicle and hit a guard rail.  He was severely injured.

During the proceedings of the case, we learned that the very area where our client lost control was an area where water would accumulate as ice melted during the day, but would refreeze and turn to ice at night when the temperature went below freezing.  Our accomplished investigators did an extensive scene investigation and found that there was a drain pipe that caused water to constantly be there.  They were able to find witnesses who knew the area well because they themselves had seen ice accumulate there whenever the temperature went below freezing.  We obtained statements from these witnesses and as a result, we were able to achieve a significant settlement for our client.
